Terms & conditions

These Terms and Conditions shall apply to the use of the facilities and services provided by Repose Studio by members, customers and other users thereof. 



Definitions and Interpretation 

1.1 In these Terms and Conditions, unless the context otherwise requires, the following expressions have the following meanings: 



“Company” means Repose Studio
“Studio” means Repose Studio and reference to the Studio shall include reference to any and all facilities and services provided thereby and all staff thereof; 
“Customer” means a customer of the Studio who has signed a registration form 
“Members” means members of the Studio who have signed a registration form or persons who have bought a Course of Classes
“Membership” means a membership of the Studio; 
“Membership Fees” means the fee(s) due for Membership; and 
“Membership Plan” means a grade of Membership as determined by the Studio



“Website” means www.reposestudio.co.uk
1.2  The Terms and Conditions are incorporated into the Registration Form and any Membership is subject to these Terms and Conditions as amended from time to time.



1.3 The Company reserve the right to vary or revoke any of the Terms and Conditions from time to time which it may consider necessary.  Any such changes will be published on our website.




2. Membership 
2.1 Acceptance of a person as a Member is at the discretion of the Company and required completion of a Registration Form.



2.2 Membership shall be in accordance with a Membership Plan. A Member’s use of the Studio must always be in accordance with their Membership Plan 
2.3 Membership plans include UNLIMITED, 10 or 15 SESSIONS PER MONTH - for all membership plans you may attend any class with availability, however you must leave at least 24 hours duration between each Power Plate session (one class per day with the exception of stretch and massage). 



2.4 The first payment of any membership plan must be paid in person and the subsequent payments to be taken monthly by standing order or auto payment.  Annual memberships are a one off payment and are for a full 12 month period from the date of payment. 



2.5 Subsequent monthly payments will be due one month after joining and thereafter on the same date every month.



2.6 Additional sessions can be purchased if required. 
2.7 Failure to make timely payment of Membership Fees may result in a late payment charge of £25. 
2.8 Members may be denied access to the Studio whilst any Membership Fees or other sums due remain outstanding.
2.9 In the event that Membership Fees remain unpaid the Studio may refer the matter to a third party debt collection company 
2.10 Un-used sessions cannot be carried over to the next month. 
2.11 As per our cancellation policy, 6 hours’ notice is required for cancellation of a class.  In the even we do not receive 6 hours’ notice or you fail to arrive to a booked class it will be deducted from your allocation for that month. 
2.12 Sessions cannot be shared or allocated to anyone else. 
2.13 Membership cannot be run in conjunction with any other offer. 
2.14 Membership may be suspended in the event of long-term illness, injury or pregnancy. Members wishing to suspend their Membership should inform the Studio of the same no later than two weeks prior to start of the month in which they wish the suspension to take effect (for the purposes of this sub-Clause 2.14, “month” refers to a membership billing period and not necessarily a calendar month). 
2.15 The Studio may require a medical certificate, doctor’s note or similar proof of illness or other incapacity for suspension under sub-Clause 2.14. 
2.16 Membership may be suspended for reasons not covered by sub-Clause 2.14 at the discretion of the management. A fee may apply for such suspension of membership 



2.17 Members who do not adhere to our cancellation policy may result in a cancellation charge equivalent to a single class session



2.18 Monthly MEMBERSHIP means a minimum of THREE consecutive months.  One month’s written notice if required to cancel any membership after the initial six month period. 




3. Direct Debit/Standing Order/Auto-payment



3.1 The provisions of this clause shall only apply to Members that subscribe to membership packages that require payment by monthly direct debit/standing order.



3.2 Any such member will forfeit their membership if they fall behind on payment for more than 30 days. Such member shall remain liable for any outstanding payments.



3.3 Membership fees must be paid in accordance with the Terms and Conditions irrespective of whether or not the Member uses the Studio's facilities.



3.4 Members shall be given no less than 28 working days' notice of any increase in their Subscription.



3.5 Any Member that is purchasing a membership plan cannot cancel their membership before the expiry of the period of 6 months from the date of their initial payment pursuant to the membership ("the Minimum membership Period").



3.6 After the expiry of the Minimum membership Period, the subscription will continue indefinitely until a Member cancels their Monthly Subscription, giving 1 calendar months’ notice from the desired cancellation date.



3.7 If a member does not pay their membership for the Minimum membership Period (or cancels their membership subscription during the minimum subscription Period) then the member is liable in full for any outstanding subscriptions in respect of the Minimum Subscription Period.



3.8 It is the responsibility of the Member to cancel any direct debit or standing order with his bank on the termination of his or her membership. Repose Studio cannot be held liable for any payments processed due to failure of a Member to cancel a direct debit or standing order.



3.9 If the subscription is paid by direct debit or credit card (or any membership fees remain outstanding beyond the due date) the Member unconditionally and irrevocably authorises Repose Studio to debit any credit or debit card provided by the member with the Monthly membership fee (or outstanding fees) without notice to the member.



4. Refunds, Returns and Cancellation Policy 
4.1 We require at least 6 hours’ notice for all cancellations and reschedules. Late notice will result in a full single session fee being charged or one course session will automatically be deducted from our pre-booked course or membership.  No refund will be given.
4.2 Cancellation of any class should be done online or by text (07557 340 447) or phone (020 8559 0520).   
4.3 All courses must be used within the time specified.  Single sessions or blocks of 12, 25 or 50 are valid for 12 months from sale and are non-refundable and non-transferable. 
4.4 Specific tailored courses require you to pre-book and complete the course within the scheduled time. 
4.5 All pre-paid packages, memberships and classes are non-refundable and non-transferable, except in the event of illness or injury at the sole discretion of the management.



4.6 Our refund policy is to make the relevant refunds within 30 working days. The refund will be made by the same method payment was received. 



4.7 Any customer or member who fails to attend 3 or more pre-booked classes with no prior cancellation will be unable to pre-book classes in the future and all future pre-booked classes will be cancelled without notice. 



5. Studio Rules 
5.1 Customers using the facilities of Repose Studio shall abide by the Studio Rules at all times. Failure to do so may result in the suspension or termination of Membership or cancellation without refund of any course or membership. 
5.2 Information provided by The Studio in literature or on our website does not constitute medical advice and all customers using the Studio are responsible for their own state of health, physical condition and well-being at all times. Before commencing any exercise regime you should consult your doctor. 
5.3 Before any Customers first exercise program or session they will be required to complete a Registration Form, it is essential that you supply us with the correct information about yourself and that you inform The Studio of any medical condition accordingly. We do not accept liability for any incorrect or misleading supplied by you. 
5.4 If you have any medical condition or are taking any medication which may affect your ability to exercise or use any equipment or facilities provided by the Studio in any way, you must inform the Studio of the same and act in accordance with any instructions provided as a result. 
5.5 Customers may only use the equipment and facilities provided by the Studio in the correct manner and must not use the same in any manner which constitutes a health and safety risk either to themselves or to others. 
5.6 Customers should not attempt to use any equipment or facilities until they have been instructed in the correct use of the same by a suitably qualified instructor. 
5.7 Use of any facility in The Studio when under the influence of alcohol or illegal drugs is strictly prohibited. 
5.8 It is not advised to use the facilities of The Studio following a heavy meal. 
5.9 No animals are allowed in the Studio with the exception of guide dogs. If a Customer requires the use of a guide dog, the Customer should inform the Studio of the same when applying for Membership or before booking and paying for any Courses. 
5.10 No smoking is permitted inside the Studio, or anywhere else on the Studio’s property (including outside areas).



5.11 With the exception of the Stretch and Massage classes, under no circumstance may any client participate in more than one class session per 24 hour period.



6. Equipment and Facilities 
6.1 All equipment is inspected and tested on a regular basis and maintenance is carried out on a regular basis or as required. 
6.2 If you become aware of any damaged or defective equipment you should immediately cease using such equipment and inform a member of staff. 
6.3 Equipment may be withdrawn at any time and for any reason including, but not limited to, maintenance, repair and alteration. 




7. Classes 
7.1 All classes, workshops and similar events provided by the Studio must be booked in advance. No priority is given and places are allocated on a first-come-first-served basis. 
7.2 Management reserve the right to request payment in advance of all class booking.



7.3 If a class requires specific clothing, footwear, or other items which Customers must provide, details of the class will specify such requirements. Customers who fail to comply with such requirements may not be permitted to participate in the class. 
7.4 Customers attending a class must arrive at least 5 minutes before the scheduled time of the class. Customers arriving later than this time risk losing their place in the class.




8. Trial Sessions 



8.1 The FREE trial sessions is intended for NEW customers only. The booking is subject to availability and the consent form. The Free trial is strictly one per person and not to be used in conjunction with any other offer or promotion.




9. Use of facilities and Children



9.1 A Customer or member is entitled to use the Studio's facilities providing always that the Studio may at any time withdraw all or part of its facilities for any period or periods and with notice, where practicable, in connection with any cleaning, repair, alteration or maintenance work or for reasons beyond the control of the Studio or the Company.



9.2 A Member that is between the age of 16 and 18 must be accompanied by an adult for the first class they take. They will not be allowed to attend unaccompanied until they have been signed off by the Studio Manger and a Parent/Guardian.



9.3 Children under the age of 16 are not permitted to use the facilities of the Studio.



9.4 At the discretion of the Studio manager, children under the age of 16 can accompany you to the studio as long as they sit in the waiting area whilst the class is in progress. Under no circumstances are they allowed to touch or use any equipment.  The staff and management of the studio take no responsibility for children that accompany you to the studio.   




10 Off – Peak Classes and Sessions 
10.1 Off Peak times are to be advised by management and are subject to change



10.2 Off Peak courses cannot be used in conjunction with any other offer or promotion. 





11 Personal Belonging and Lost Property 
11.1 Repose Studio accepts no responsibility for any property left on the premises. 
11.2 Lost property will be kept for one month after which time it will be disposed of. 



11.3Personal belongings are brought onto the Studio premises at the Member's risk and the Company does not accept liability for any loss or damage whatever to such items. For security reasons Members are advised keep valuable items with them at all times and not leave them in the lockers or changing area.




12 General 
12.1 Your rights as a consumer under consumer protection legislation from time to time in force shall not be affected by these Terms and Conditions. 
12.2 The Studio may, from time to time, change these Terms and Conditions without notice, however it will use its reasonable endeavours to inform Members and Customers as soon as is reasonably possible of any such changes. 



12.3  Customers and members must at all times observe the Studio guidelines which may be notified to them from time to time and are requested to comply with any reasonable directions which the management of the Studio may issue to ensure the smooth operation of the Studio for the convenience of all Members.



12.4 Members are required to give notice to the Company of any change of home address, phone number or email address. Failing such notice, all communications shall be assumed to have been received by the Member within 5 days of mailing to the last address (of either type) notified to the Company.



12.5 The Company may communicate with the Member by electronic mail ("email"). By providing an email address to the Company the Member consents to receiving email communications from the Company, including notices pursuant to the Terms and Conditions. The Member also accepts any risk that email may not be a fully secure and confidential means of communication. The Company will not be liable for any loss or damage suffered as a result of communicating with a Member in this manner.




13 Limitation of Liability



13.1 The Company cannot be held responsible for any service or equipment not being available for whatever reason. The Company reserves the right to make alterations to the types of facilities provided, without notice and in its absolute discretion and the Company shall not be liable for any loss occasioned by such alterations except in so far as loss is by law incapable of exclusion.



13.2 It is the Member's responsibility to ensure that they are capable of joining in any exercises class they attend. Members accept the risk of injury from performing exercises and are advised to consult their doctor prior to beginning any programme or class.



13.3 Neither Repose Studio or it’s, employees or agents shall be liable for any death, personal Injury or illness occurring upon any Repose Studio Premises or as a result of the use of the facilities and/or equipment provided by Repose Studio, except to the extent that such death, personal injury or illness arises from any negligent act or omission of Repose Studio or its employees, agents or subcontractors.



13.4 The Company accepts no liability for loss or damage to property or injury of Members or their guests to them on the Studio premises or outside the Studio except in so far as such loss, damage, or injury is by law incapable of exclusion.



13.5 Customers, their heir and legal representatives knowingly and voluntarily waive any future claim they may have against Repose Studio or any partner, employee or instructor at Repose Studio for any injury, condition or damages you may sustain from being on our premises, participating in classes or following advice.






14 Data Protection 
14.1 The Studio will not share Customers’ personal data with any third parties for any reasons without the prior consent of the Customer concerned. Such data will only be collected, processed and held in accordance with the Studio’s rights and obligations arising under the provisions and principles of the Data Protection Act 1998. 



14.2 We may want to use some of the information you have provided for the purpose of monitoring, assessing or marketing Repose Studio and to inform you of any offers, information and services and products.  We undertake never to sell or otherwise distribute any personal information of you to third parties.




15 Law and Jurisdiction 



15.1 These Terms and Conditions (including any non-contractual matters and obligations arising there from or associated therewith) shall be governed by, and construed in accordance with, the laws of England and Wales. 



15.2 Any dispute, controversy, proceedings or claim between the Parties relating to these Terms and Conditions (including any non-contractual matters and obligations arising there from or associated therewith) shall fall within the jurisdiction of the courts of England and Wales.
